This website is operated by KOA (“Company,” “we,” “our,” or “us”). By accessing this website or engaging in services, you agree to be bound by the following Terms and Conditions.

S E V I C E S

KOA provides creative services including, but not limited to:

  • Brand Identity Design
  • Website Design & Development
  • Social Media Management
  • Creative Strategy & Consulting

All services are governed by a separate written client agreement outlining scope, timelines, deliverables, and payment structure.

P A Y M E N T  T E R M S

All projects require a non-refundable deposit to secure booking.

Remaining balances must be paid according to the payment schedule outlined in your contract. Late payments may result in project pauses, delayed delivery, or additional fees.

I N T E L L E C T U A L  P R O P E R T Y

All content on this website, including text, graphics, designs, and materials, is the intellectual property of KOA unless otherwise stated.

For client work:
Final approved deliverables become the client’s property once full payment is received.

KOA retains the right to display completed work for portfolio and marketing purposes unless otherwise agreed in writing.

R E V I S I O N S  &  S C O P E

Projects include a defined number of revisions as outlined in your contract. Additional revisions or scope changes may incur additional fees.

L I M I T A T I O N  OF  L I A B I L I T Y 

KOA is not liable for business outcomes, revenue performance, website traffic results, or marketing results. Creative services are strategic and aesthetic in nature; implementation and market response are outside our control.

G O V E R N I N G  L A W

These Terms are governed by the laws of the State of Georgia.

C A N C E L L A T I O N  &  T E R M I N A T I O N

If the Client chooses to cancel the project after work has begun, the initial 50% deposit remains non-refundable.

If cancellation occurs after substantial progress has been made, the Client is responsible for payment for work completed up to the cancellation date. Any additional outstanding balance for completed work will be invoiced and due within 7 days.

KOA reserves the right to terminate a project at any time if communication breaks down, payment terms are not met, or the working relationship becomes misaligned. In such cases, payment for work completed will be required prior to termination.

F O R C E  M A J E U R E

KOA shall not be held liable for any delay or failure to perform resulting from causes beyond reasonable control, including but not limited to acts of God, natural disasters, illness, government restrictions, power outages, internet disruptions, or other unforeseen circumstances.

In such events, project timelines may be extended accordingly.

C L I E N T  I N A C T I V I T Y

Timely communication is essential to maintaining project momentum.

If the Client fails to respond, provide requested materials, approvals, or feedback for a period of 7 consecutive calendar days, the project will be considered paused.

During a paused period:

  • KOA reserves the right to reschedule the project based on current availability.
  • A restart fee may apply to resume work.
  • Original delivery timelines are no longer guaranteed.

If inactivity extends beyond 30 days, KOA reserves the right to terminate the project, and all payments made up to that point remain non-refundable.
E A R L Y   T E R M I N A T I O N  &  T E R M I N A T I O N   F E E

If the Client chooses to terminate the project after work has commenced but prior to completion, the initial 50% deposit remains non-refundable.

If termination occurs after substantial work has been completed (defined as the project being at a stage where significant strategic and creative development has occurred or more of the agreed project scope), the remaining balance becomes immediately due as a termination fee.
